1. Acceptance of Terms
By accessing or using the services provided by AarneX FinServ ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms are to be read in conjunction with our Privacy Policy and are compliant with the Digital Personal Data Protection Act (DPDP Act), 2023. Electronic acceptance of these Terms shall have the same legal effect as a physical signature under applicable Indian law.
Continued use of the platform constitutes binding acceptance of these Terms and any subsequent revisions. Nothing in these Terms constitutes financial, credit, or investment advice.
2. Legal Status & Nature of Services
AarneX FinServ is operated by its Proprietor, Mr. Rahul Tripathi, under a sole proprietorship structure under applicable Indian law.
We serve strictly as an independent, non-lender, referral-based Digital Lending Facilitator and Direct Sales Associate (DSA). Specifically:
- Operational Scope: We do not operate any lending system, API integration, or underwriting mechanism with Banks or NBFCs; we perform only referral-based lead facilitation.
- Independent Contractor: We act as an independent contractor and not as an employee or agent of any regulated entity. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship with any lender or user. Nothing in these Terms creates any fiduciary, trustee, or advisory relationship.
- No Authorization: We are not authorized, empaneled, or officially appointed by any Bank or NBFC, unless expressly confirmed in writing via an executed agreement with the respective institution.
- No Representation: We do not represent any Bank or NBFC in any official capacity.
3. Approval, Lead Conversion & Consent
AarneX FinServ is not a lender.
- No Guarantee: We make no representation or guarantee regarding loan approval, pricing, sanction amount, or disbursement. We do not guarantee the conversion of any lead into an approved loan or financial product.
- Indicative Status: Any eligibility indication is purely informational, subject to independent verification by the lending institution, and does not constitute a binding offer, guarantee, or any contractual commitment.
- Communication: We do not communicate final eligibility or approval on behalf of any lending institution.
- Consent Separation: By using our services, you provide distinct, granular consents: (i) for the processing of your data to facilitate your loan inquiry; (ii) for sharing your data with regulated lending institutions as requested; and (iii) separately for receiving marketing or promotional communications. You may withdraw these consents independently at any time via the mechanism outlined in our Privacy Policy.
4. User Obligations, Impersonation & Fraud
- Accuracy: Users are solely responsible for the accuracy of all submitted data.
- Impersonation & Fraud: Unauthorized use of the AarneX FinServ name or identity for misleading representation is strictly prohibited. Any fraudulent activity conducted by third parties falsely claiming association with AarneX FinServ shall not create any liability on our part. If you encounter suspicious communication or impersonation, users are encouraged to report it to care@aarnexfinserv.com. We may, at our discretion, issue advisories regarding known impersonation attempts where feasible, without any obligation to do so.
- Agent Miscommunication: Any representations, promises, or commitments made by our representatives that contradict these Terms are non-binding and unauthorized.
5. Service Availability & Performance
We do not guarantee uninterrupted, secure, or error-free availability of the platform. We reserve the right to temporarily suspend services for maintenance, security updates, or technical improvements without prior notice.
6. Limitation of Liability & Data Responsibility
To the maximum extent permitted by applicable law:
- Liability Cutoff: Our responsibility ends at the point of lawful data transfer to the respective institution or service provider. Upon lawful transfer of data, the receiving entity acts as an independent Data Fiduciary under the DPDP Act, 2023, and AarneX FinServ shall not be responsible for their subsequent processing or handling of data to the extent permitted under applicable law.
- Relationship Disputes: We are not responsible for any disputes between users and lending institutions.
- Disclaimer: As a facilitator, we shall not be liable for any direct, indirect, or consequential damages arising from the actions, omissions, or lending decisions of any third-party institution. We are not responsible for any independent decisions, policies, or actions of third-party institutions.
7. Intellectual Property
All content, trademarks, logos, and digital designs displayed on the AarneX FinServ platform are the exclusive property of AarneX FinServ. You may not reproduce, distribute, or modify any materials without our express written consent.
8. Indemnification & Force Majeure
- Indemnification: You agree to indemnify, defend, and hold harmless AarneX FinServ and its Proprietor from any claims, losses, or damages (including reasonable legal fees) arising from your misuse of our services or your violation of these Terms.
- Force Majeure: AarneX FinServ shall not be liable for failure or delay caused by events beyond our reasonable control, including but not limited to, acts of God, war, strikes, cyber-attacks, power outages, or governmental restrictions.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India.
